Subject: Bernstein case remanded to panel
The 9th Circuit issued an order today remanding the Bernstein case from the en banc panel back to the three-judge panel that originally heard it for further consideration in light of the new cryptography regulations issued by the government on January 14, 2000. Presumably the panel will seek further briefing on the effect of the new regulations on the case.
Also in light of the new regulations, Bernstein has requested an Advisory Opinion from the Commerce Department. Bernstein's letter requesting the Opinion, consisting of about eight pages of questions seeking clarification about the new regulations, is available at http://cryptome.org/bernstein-bxa.htm.
Bernstein expects to receive the Advisory Opinion by February 7, 2000.
